ZYNEXEL – Liability Waiver

This Liability Waiver (“Waiver”) applies to all installation, configuration, wiring, field services, and technology-integration work performed by Zynexel and its divisions (Zynexel Network, Zynexel Fiber, Zynexel Tools, and future Zynexel IT).
By requesting or receiving services, the customer (“Client”) acknowledges and agrees to the following terms.
1. Assumption of Risk
Client understands that installation of cameras, routers, WiFi systems, cable runs, drilling, and other on-site technical work involves inherent risks, including but not limited to:
Drilling holes in walls, ceilings, or exterior surfaces
Exposing existing wiring or structural flaws
Temporary disruption of internet or electrical equipment
Device malfunction due to building materials or third-party hardware
Client voluntarily assumes all risks associated with these procedures.
2. No Guarantee of Performance
Zynexel provides installation services on a best-effort basis and does not guarantee:
Internet speed or WiFi performance
Camera video quality, connectivity, or uptime
System coverage or signal range
ISP reliability or stability
Security system effectiveness
Prevention of loss, theft, or unauthorized entry
Performance depends on factors outside Zynexel’s control, including the Client’s internet provider, device quality, environment, and maintenance.
3. Third-Party Equipment Responsibility
All hardware installed by Zynexel (routers, cameras, smart devices, etc.) is manufactured by third-party companies.
Zynexel is not responsible for:
Manufacturer defects
Future malfunctions
Device software failures
Cloud storage or subscription issues
Product warranties or replacements
All product warranties are handled directly with the manufacturer (Reolink, TP-Link, Eero, Ring, Lorex, etc.).
4. Property Damage Waiver
Client acknowledges that standard installation procedures may involve:
Drilling
Mounting
Exterior cable routing
Penetration of walls, siding, or ceilings
Client agrees that Zynexel is not liable for:
Cosmetic damage from normal installation (patch marks, small drill holes, paint scuffs)
Issues caused by old, brittle, or unstable building materials
Pre-existing structural weaknesses
Hidden electrical, plumbing, or construction hazards encountered on-site
Client releases Zynexel from any claims relating to these conditions.
5. Network & ISP Limitations
Client understands that Zynexel is not responsible for:
Internet outages
ISP throttling or instability
Slow speeds caused by the provider
Faulty modems, routers, ONTs, or ISP equipment
Local interference or congestion
Future network changes made by the ISP
Any ISP-related issues must be resolved directly with the provider
6. Release of Liability
To the fullest extent permitted by law, the Client releases, waives, and discharges Zynexel from all liability for:
Property damage
Loss of data
Device failure
Service interruptions
Theft, intrusion, or security breaches
Personal injury, including incidents involving ladders or tools on the Client’s property
Consequential or incidental damages
This release applies whether the claim is based on negligence, equipment failure, environmental conditions, or any other cause.
7. Indemnification
Client agrees to indemnify and hold Zynexel harmless from any claims, losses, damages, or legal expenses arising from:
Misuse of equipment
Unauthorized alterations
Customer-provided devices
Hazardous property conditions
Interference by other contractors
Failure to follow Zynexel’s recommendations
8. No Ongoing Monitoring
Zynexel does not:
Monitor cameras or security feeds
Store video or customer data
Guarantee recording retention
Provide emergency response services
Client is fully responsible for managing their own camera systems, subscriptions, apps, and security behavior.
9. Acknowledgment
By requesting service, receiving a quote, scheduling an installation, or allowing Zynexel technicians on-site, the Client acknowledges:
✔ They have read and understand this Liability Waiver
✔ They voluntarily agree to its terms
✔ They accept responsibility for all associated risks
✔ They release Zynexel from liability as stated
